Is a broken tooth gbh or abh?

In UK law the distinction between what constitutes GBH and ABH is whether or not the skin has been broken. If it has then it is GBH. I suspect in this case there was perhaps more injuries than a broken tooth.





I learnt this when on jury service years ago when a guy, who admittedly was more than a bit of a bad lad, was accused of, among other things, assaulting half a dozen cops in the back of a police van. The policemen's injuries consisted solely of knuckle injuries and the wounds broke the skin - that, after lots of legal deliberation, was deemed to be GBH.

Reply:Just a broken tooth (I am assuming that you mean in an assault case)? It would be difficult to gain a conviction for anything more than ABH.
Reply:i would guess assault as no bodily harm has occurred
Reply:Put a little bread on it to help with the pain from the air getting to it contact a dentist within 24 hrs to fix so the tooth doesn't die





.If you broke it on food like fast food notify the local company then ask the corporate company to fix it


.If its due to a fall because of someone negligence because crap on the floor and shush notify corporate company to fix it Notify the store and or property owner to pay the bill within 24 hrs period.
Reply:I'd say neither - crying over a broken tooth is just being a complete girls blouse. Yes, the system stinks. If I were the judge I'd tell her to pull herself together. Next thing you know they'll be banging people up for breaking someone's nail.

Reply:Under English law, we were always taught at law school that abh STARTS with broken teeth...GBH is "really serious harm". Broken teeth shouldn't be GBH. If it were me, I'd appeal.





Unless your mate did some other naughty things he's not told you about...
Reply:A broken tooth is ABH, but perhaps there was graver damage? A broken jaw, perhaps?
